Las Vegas Monorail, Las Vegas, Nevada
The Las Vegas monorail was a joint venture between Granite Construction Company and Bombardier who supplied the monorail and operated the system. A $50,000 per day liquidated damage clause was included in the contract which Zurich Insurance Company agreed to insure as part of their coverage for performance. Because the critical path schedule contained one year of float, everyone felt safe as the project started. To the surprise of all parties, the one year float was not enough as delays and unforeseen issues accumulated throughout the project. Seven months after the scheduled completion date, the monorail failed to meet performance standards for public use, and Zurich Insurance Company was notified of their obligations to pay 30 million for liquidated damages.
A team of experts was formed to investigate the cause of delay and report facts to Zurich’s London office. Gogulski & Associates was a key part of that team.
As the critical path was analyzed, it became apparent that flawed logic and incomplete data was presented during monthly updates. The analysis proved significant manipulation occurred to conceal facts and avoid the issues where failure to perform prevailed. As an example, the activities used to make up the schedule totaled over 4,000 and varied month to month. . One month, 2,500 activities would be deleted and 1,000 new activities added. The entire scheduling process was flawed and failed to provide a realistic critical path.
After analysis, Gogulski & Associates found substantial owner caused delays which were omitted from the claim process during the course of construction. This presented a political problem as Zurich did not want to penalize their client who has a long standing relationship and many larger fully insured projects. Instead, the presentation to Zurich relied on the delays relating to new and unproved technology for system controls. This case was settled privately in London among the barristers and attorneys using the facts established by Gogulski and other team members.
